1.1 If you use the Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind the entity to this Agreement, and "you" includes both you and the entity.

1.2 The Services are not intended for individuals under 18. Any use by minors must have the express written permission of their legal guardian. Use by individuals under 13 is strictly prohibited.

3.1 You agree not to: (a) reverse engineer, decompile, disassemble, or discover the source code of the Services; (b) re-identify anonymized data; (c) modify or create derivative works based on the Services; (d) use the Services for time sharing or service bureau purposes; (e) remove proprietary notices; (f) circumvent security controls; or (g) use the Services in competition with MapZot.

3.2 You will use the Services in compliance with all applicable laws and regulations. MapZot reserves the right to monitor and prohibit any use it deems inappropriate.

3.3 You are responsible for maintaining the equipment and ancillary services needed to access the Services and for securing your account and associated data.

3.4 You may access and use MapZot Data subject to restrictions on re-identification, profiling, and certain prohibited uses, including use for employment, healthcare, credit, or insurance eligibility, automatic decision-making, unlawful tracking or surveillance, or marketing to law enforcement agencies.

4.1 MapZot retains all rights, title, and interest in and to the Services, including improvements, enhancements, modifications, and related intellectual property.

4.2 Feedback provided to MapZot may be used to improve the Services without any obligation to you.

4.3 By uploading data ("Customer Data") to the Services, you grant MapZot a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable right to use the data in an aggregated and de-identified format. This license does not affect your ownership of your Customer Data.

5.1 This Agreement remains effective until terminated.

5.2 You may terminate your use of the Services at any time. MapZot may terminate your access to the Services at any time for any reason.

5.3 MapZot may suspend or terminate your account if it suspects a violation of this Agreement or any illegal or harmful activity.

5.4 Sections 3, 4, 5.4, and 6 through 11 of these Terms of Service, and the Privacy Policy will survive termination.

6.1 The Services are provided "as is" without warranties of any kind. MapZot does not warrant that the Services will meet your requirements, be uninterrupted or error-free, or be free of harmful code.

6.2 MapZot is not responsible for backing up your data or for any decisions made based on the Services.

8.1 MapZot is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. MapZot's total liability is limited to the amount you paid for the Services in the 90 days preceding your claim.

8.2 Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

11.1 MapZot may change this Agreement by posting amended terms on the Site. Continued use of the Services constitutes acceptance of such changes.

11.2 MapZot may modify or discontinue the Services at any time without notice or liability.

11.3 This Agreement constitutes the entire agreement between you and MapZot.

11.4 The failure to exercise any right or provision of this Agreement does not constitute a waiver.

11.5 If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

11.6 You may not assign this Agreement without MapZot's consent. MapZot may assign this Agreement without restriction.

11.7 No agency, partnership, joint venture, or employment is created by this Agreement.

11.8 You grant MapZot a license to use your company name, logo, and public comments for promotional purposes.

11.9 This Agreement is governed by Georgia law. Any disputes will be resolved by arbitration in Georgia under JAMS Streamlined Arbitration Rules.
